1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of websites, applications, trainings, educational materials, coaching programs, products, communications, and services operated by Thrive Men's Coaching LLC ("Company," "we," "us," or "our").

These Terms apply to thrivemenscoaching.com, Empowered Husband, and related landing pages, applications, consultation booking pages, coaching platforms, communities, and other services operated by the Company.

By accessing or using our website or services, you agree to these Terms.

If you do not agree, you should discontinue using the relevant website or services.

Certain coaching programs, purchases, or memberships may also be governed by separate written agreements. Where a signed coaching agreement contains specific provisions concerning payment, program delivery, guarantees, refunds, or cancellation, that agreement controls those matters to the extent of any conflict with these general Terms.

2. Eligibility

Our website, programs, and services are intended for individuals who are at least 18 years old.

By using our services, you represent that you are legally capable of entering into binding agreements and that the information you provide is accurate to the best of your knowledge.

We reserve the right to update our educational materials, program structures, delivery methods, and other features when reasonably necessary, subject to any obligations in an applicable coaching agreement.

4. Coaching and Educational Disclaimer

Our programs are intended for education, personal development, relationship improvement, emotional leadership, communication development, and coaching.

Our services are not psychotherapy, marriage counseling, mental health treatment, medical treatment, legal advice, or financial advice.

Unless expressly disclosed otherwise, our coaches do not provide services in the capacity of licensed therapists, psychologists, medical providers, attorneys, or other regulated professionals.

Information provided through our programs is not intended to diagnose or treat physical or mental health conditions.

Coaching is not a substitute for appropriate care from a licensed or qualified professional.

Individuals experiencing mental health emergencies, domestic violence, abuse, threats, or other safety concerns should seek appropriate professional or emergency assistance.

Participation in our programs does not establish a therapist-patient, attorney-client, or other regulated professional relationship.

5. Personal Responsibility

You acknowledge that coaching requires your active participation, personal responsibility, and independent decision-making.

Any recommendations, exercises, strategies, or information provided through our services are intended as educational guidance.

You remain responsible for your decisions, behavior, communication, relationships, and actions.

We do not control the decisions, emotions, choices, or behavior of your spouse, partner, family members, or any other third party.

You agree to exercise independent judgment in applying information obtained through our services.

6. Relationship Outcomes and Results

Our programs are designed to help participants improve personal leadership, communication, emotional regulation, self-awareness, and relationship patterns.

However, individual circumstances vary significantly, and relationship outcomes depend on factors beyond the Company's control.

We cannot guarantee that your spouse or partner will:

- Reconcile with you

- Return to the relationship

- Stop or reverse divorce proceedings

- Change their feelings or behavior

- Agree to counseling or reconciliation

- Remain married

- Respond in a particular way

No testimonial, success story, educational example, or general marketing statement should be interpreted as an unconditional promise of a particular relationship outcome.

Any specific written guarantee offered in connection with a coaching program is governed exclusively by its applicable terms and conditions.

7. Coaching Guarantees and Refund Policies

The Company may periodically offer guarantees or refund arrangements in connection with specific coaching programs.

Such guarantees may be described in promotional materials or sales presentations, including statements concerning marriage improvement or helping participants work toward saving their marriages.

**Any guarantee is subject to the specific written terms provided to the client at enrollment.**

A guarantee is not automatically included with every purchase or program.

Eligibility, participation requirements, qualifying circumstances, time periods, refund procedures, exclusions, and available remedies are determined by the applicable written coaching agreement.

Where a guarantee requires active participation, clients may be required to attend coaching sessions, complete assigned work, follow the agreed program process, communicate honestly, and otherwise satisfy the requirements stated in their written agreement.

No guarantee should be interpreted to mean that the Company can control or compel a spouse or partner to take any particular action.

Unless otherwise required by applicable law or expressly provided in a written agreement, payments are nonrefundable once paid.

Any applicable refunds, credits, payment obligations, cancellations, or remedies will be governed by the client's written agreement and applicable law.

8. Payments and Purchases

Pricing, payment schedules, financing arrangements, and purchase conditions will be communicated before enrollment or purchase.

By purchasing a product or service, you agree to the payment terms associated with that purchase.

Where an installment arrangement is provided, you agree to make payments in accordance with the applicable written agreement.

Failure to make required payments may result in restrictions on access to services, subject to the terms of your agreement and applicable law.

Payments may be processed through third-party payment providers, which may maintain separate service terms and privacy policies.

9. Consultations and Applications

Submitting an application does not guarantee acceptance into any coaching program.

We may review applications to determine whether our services appear appropriate for an applicant's goals, circumstances, and needs.

Consultation availability may be limited.

Booking a free consultation does not obligate you to purchase coaching services.

Applicants are responsible for providing accurate contact information and attending scheduled appointments or communicating when rescheduling is necessary.

We reserve the right to decline or restrict repeated consultation bookings in cases of missed appointments, misuse, or other legitimate operational concerns.

10. SMS Messaging Terms & Conditions

**Program Name:** Thrive Men's Coaching LLC SMS Communications

**Program Description:** Thrive Men's Coaching LLC provides optional automated text messages relating to coaching applications, booking confirmations, appointment reminders, and scheduling updates, including appointment changes and rescheduling information.

This SMS program does not send promotional offers or marketing messages.

Message Frequency: Message frequency varies depending on application status and scheduled appointments. Messages may be recurring.

Message and Data Rates: Message and data rates may apply.

Consent: SMS consent is voluntary and is not required to purchase any product or service. Providing a phone number or submitting an application does not automatically subscribe you to SMS communications.

Opt-Out Instructions: Reply STOP to any text message to unsubscribe from SMS communications.**

Participants receive a limited, personal, nonexclusive, nontransferable license to use materials provided in connection with their enrollment for their own personal development, subject to any additional written agreement.

Participants in coaching communities, group sessions, or related services are expected to conduct themselves respectfully.

- Engage in fraudulent, unlawful, or disruptive conduct

- Misuse community materials or services

We may moderate communities and restrict participation where reasonably necessary to protect other participants or the integrity of our services.

Such actions remain subject to applicable laws and contractual obligations.

14. Testimonials and Client Experiences

To the fullest extent permitted by applicable law, website content, free educational materials, and general information are provided on an "as is" and "as available" basis.

We do not make warranties concerning the accuracy, completeness, availability, or suitability of general informational content for every individual circumstance.

Nothing in these Terms excludes any warranty or consumer protection that cannot lawfully be excluded.

Specific service commitments expressly established in a written coaching agreement remain subject to that agreement.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Thrive Men's Coaching LLC and its owners, employees, contractors, coaches, agents, and representatives shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of our website, educational information, or services.

This includes, where legally permitted, damages associated with lost opportunities, lost income, relationship difficulties, or decisions made independently by participants.

The Company is not responsible for decisions or actions taken by spouses, partners, family members, or other third parties.

Nothing in these Terms limits liability that cannot legally be excluded or limits remedies expressly guaranteed under an applicable written coaching agreement.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Thrive Men's Coaching LLC and its owners, employees, contractors, representatives, and agents against third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from your unlawful conduct, misuse of our services, infringement of third-party rights, or material violation of these Terms.

This provision does not apply to claims resulting from the Company's own unlawful conduct or to the extent prohibited by applicable law.

20. Termination and Restriction of Access

Any termination of paid coaching services, related refunds, and outstanding payment obligations will be governed by the applicable written agreement and applicable law.

To the extent permitted by applicable law, legal disputes arising from these Terms shall be brought in the appropriate state or federal courts located in Travis County, Texas.

Any separate dispute resolution provisions contained in an applicable signed coaching agreement shall govern disputes covered by that agreement.

Nothing in this section removes rights or remedies that cannot lawfully be waived.

23. Changes to These Terms

We may revise these Terms to reflect changes in our website, services, business operations, or legal obligations.

The effective or revision date at the beginning of this document will indicate when the Terms were last updated.

Material changes to existing paid agreements will be governed by those agreements and applicable law.

25. Entire Agreement

These Terms, together with our Privacy Policy and any applicable written coaching agreement, constitute the relevant agreement governing the use of our website and services.

Where specific provisions of a written coaching agreement conflict with these general Terms, the written agreement controls the matters it expressly governs.

Failure to enforce a particular provision does not constitute a waiver of our right to enforce it later.
